Purpose

By means of this text we make available to all users and customers the conditions of use and registration applicable to our online services platform www.axalingua.com and the services we provide, reflecting all the rights and obligations of the parties.

All users who visit or access our platform and/or use any of the services made available accept the terms of use and privacy policy, as well as any future modifications and/or additional legal texts. If you do not agree with any of the conditions, you may unsubscribe from the service at any time or, if you are not a registered user, leave the platform.

In addition to these conditions, each of the services provided may be governed by specific terms of use and registration, which the user must expressly accept before use and/or contracting.

User Registration and Access

Any user, provided they are over 18 years of age and, where acting on behalf of a third party (natural or legal person), hold sufficient authority to do so, may register on our platform.

To do so, the user need only access the registration form, enter the requested details and accept the terms of use and registration, as well as the privacy policy governing the relationship between the user and the provider.

Using the username and password created during registration, the user may access the platform to purchase and manage their services and information, as well as complete their user profile.

Electronic Contracting of Services

In accordance with Article 23 et seq. of Law 34/2002 on information society services and electronic commerce, contracts entered into electronically shall produce all legal effects provided that the consent of both parties is given and can be evidenced.

The contracting conditions below apply directly to the contracting of all services made available through www.axalingua.com, unless expressly stated otherwise.

Contracting procedure: carried out entirely electronically, in three phases visible to the user: user identification, selection of service and payment method, and confirmation of the service. Once the service is selected, the platform will display a summary of the order and the applicable conditions, which must be expressly accepted to continue. For electronic payments, the user will be redirected to the corresponding external payment gateway; Axalingua S.L. never has access to card details or payment systems.

Within a maximum of 24 hours, the customer will receive an email with all information relating to the contracted service, which will serve as confirmation and proof of the order.

Right of Withdrawal

In accordance with Royal Legislative Decree 1/2007, of 16 November, and Article 45 of Law 7/1996 on Retail Trade, the user has the right to withdraw from the contract from the moment the service is contracted.

Once the request is received, the amount paid (excluding shipping or handling costs) will be refunded within a maximum of 14 calendar days, using the same payment method or by bank transfer.

Exercising the right of withdrawal requires that the user has not consumed or enjoyed the contracted services. If the services have already been used, this right cannot be exercised.

User Obligations

  • Not to use the platform to carry out unauthorised operations or make it available to third parties without consent.
  • Not to subject the platform to reverse engineering, decompilation or disassembly of its software.
  • Not to use it to manage or exchange illegal content or content contrary to morality, public order or third-party rights.
  • Not to subject it to workloads aimed at destabilising it (DDoS attacks or similar).
  • Not to translate, adapt, modify or incorporate the platform into other software or portals.
  • Not to remove or alter intellectual or industrial property notices included on the platform.
  • To pay the amounts indicated in a timely manner.
  • To report any security incident of which they become aware.

Warranties and Liabilities

Axalingua S.L. is committed to the proper functioning of its services in accordance with the agreed conditions. However, it is not responsible, among other cases, for: information published by third parties unrelated to the organisation; unavailability of the platform due to technical causes attributable to third parties or force majeure; use by users of the platform to disseminate unlawful, defamatory or public-order-infringing content; or damage caused by viruses or malicious code introduced by third parties.

If the contracted services are unavailable for more than 72 hours from notification of the incident, the user may request termination of the contract and a refund of the amounts corresponding to the services not enjoyed.

If any content accessible through the platform is found to be contrary to applicable regulations, Axalingua S.L. undertakes to remove it immediately upon becoming aware of it.

Intellectual and Industrial Property Rights

Axalingua S.L. is the legitimate owner of the platform and of all copyright, intellectual and industrial property rights associated with it, including its structure, code, know-how, methodologies and content (texts, images, databases and associated materials).

Mere access to the platform does not imply any transfer of ownership. The user is granted a non-exclusive licence to use it, limited in time to each connection period, non-transferable, revocable and non-sublicensable, solely for ordinary use of the platform.

Any reproduction, transmission, modification or public communication of the content without the express written authorisation of Axalingua S.L. is prohibited.

All content and information published by users on the platform remains their exclusive property; Axalingua S.L. acts solely as a hosting service provider for such information.

Confidentiality and Data Protection

In accordance with Regulation (EU) 2016/679 (GDPR), all personal data provided during use of the platform and provision of the services will be processed in accordance with our Privacy Policy, which the user must expressly accept prior to registration.

By accepting these conditions, the user expressly and unequivocally accepts the aforementioned Privacy Policy, and may at any time exercise the rights of access, rectification, cancellation and objection regarding their personal data, as detailed therein.

Term and Economic Conditions

Duration: these conditions take effect on the date the service is contracted and remain valid for one year, tacitly renewed for annual periods unless expressly cancelled at least 30 days before the start of the following period. Services contracted as packages or promotions may have a shorter, specific duration, stated before contracting.

Rates and payment: the applicable rates are solely those published on the platform, except in the case of typographical errors, which will be corrected immediately. Axalingua S.L. reserves the right to cancel orders with pricing errors within 7 days of being placed, and to modify rates without retroactive effect. Payment may be made by direct debit or credit card; Axalingua S.L. never has access to the user's bank details.

Termination of contract: the contract may be terminated for breach of the obligations set out herein, upon expiry of the term without renewal, for non-payment (with automatic suspension of the service until regularised), or due to dissolution or loss of legal personality of either party. To fully terminate the contract, the user must pay any outstanding amounts; in the event of unilateral termination without justified cause, the user waives any claim to amounts already paid.

Dispute Resolution and Applicable Law

In accordance with Article 14 of Regulation (EU) 524/2013 on consumer dispute resolution, users are provided with a direct link to the European Union's online dispute resolution platform: https://ec.europa.eu/consumers/odr/main/index.cfm

Spanish law shall apply to any dispute arising from these conditions, and any legal disputes shall be submitted to the Courts and Tribunals of the user's or customer's domicile.

Enrolment Cancellation Conditions

Cancellation by the student: the student may request cancellation of their enrolment or contracted course by written communication to info@axalingua.com. If cancellation is requested more than 15 calendar days before the course start date, the full amount paid will be refunded, excluding any administrative costs already incurred. If requested between 15 and 7 calendar days before the start date, 50% of the amount paid will be refunded. If requested less than 7 days before the start date or after the course has begun, no refund will be given, except in duly justified cases of force majeure. Refunds will be processed within a maximum of 14 calendar days from acceptance of the cancellation, using the same payment method originally used.

Cancellation by the centre: if Axalingua S.L. is required to cancel a contracted course, the student will be notified as far in advance as possible and offered, alternatively: (a) a change to another equivalent date or format, or (b) a full refund of the amount paid for the hours not delivered. Under no circumstances will the teaching hours actually contracted by the student be reduced; if necessary, part of those hours may be delivered online or as academic tutoring sessions with self-directed learning activities and follow-up by the centre, at no additional cost to the student.

These conditions are established in accordance with applicable consumer protection legislation.

Certificates of Achievement

Upon completion of the course, students will receive a certificate of achievement detailing the hours completed and the level of competence acquired, provided they have met the minimum attendance requirement and completed the assessment activities set by the centre.
